I have not bought a gun from a private party in years but I noticed a pistol in our local online classifieds that I am interested in. I imagine this is federally controlled versus state, so I am posing my question here.

What do I have to do, paperwork wise, to buy a weapon from a private party that I can simply go pick up, versus have shipped?

Thanks in advance.

That largely depends on the person your buying the gun from. Legally you need to both go to an FFL to handle the legal transfer.

It really depends on your state laws. Here in FL private sales between individuals does not require any license or documentation but it must be an in person, private party sale. That means no shipping and no crossing state lines. No dealers or FFL licensing required.

As long as the sale does not cross state line it's governed by state laws first so check Utah law. The most reliable source would probably be a local gun dealer, they should know the law inside and out.

Fla has some good gun laws, The brady bunch had billboards on 75 when you came into the state warning tourists that Fla residents could use deadly force if they felt there life was threatened.

Fortunately there is no federal requirement to go through an FFL in an FTF transaction
YET! And thats a BIG YET!
Thats one the gun haters have been begging for, for years now, so that EVERY transfer generates a paper trail and a defacto registration system.
It's what the "Gunshow Loophole" hoax, if really about.
All local laws still apply to a personal transaction, for example here in Illinois even private individuals must observe Illinois stupid waiting period law.

I believe that the owner of the gun can ship directly to the buyers FFL... and only to the FFL's address. It is the same thing as you sending it back to the company. You may mail it directly. I put a copy of the FFL in the box with the pistol and hold the original copy in my records.

I have considerable experience doing this... so, I hope I am correct. ;)

Yes I'm afraid we're stuck with it forever, as long as the chicagocrats have control of the general assembly.
