FARMINGTON HILLS, Mich. - Farmington Hills police said an apparent road rage incident led a man to fire shots into another car on Orchard Lake Road near 13 Mile Road.

1 Injured, 1 Arrested In Shooting On Orchard Lake

Police said a 27-year-old male driver in a black Nissan Maxima shot at a burgundy Audi that had two people inside, striking a man in the arm.

Police said the victim, a 20-year-old man, was taken to an area hospital and is expected to be OK. The other person in the Audi was not shot.

"I heard the sound and I said 'Kathleen there's a gunshot'," said witness Cathy Cosolla.

Police said the shooter was arrested at the scene. No charges have been filed at this point.

The suspected shooter reportedly told police the driver of the Maxima kept hitting the brakes, the drivers threw gestures at each other, and the victim got out of his car to confront the driver of the Maxima.

Kevin Wildey said he heard the exchange.

“[The suspected shooter] said ‘He was gonna spit on my face so I shot him,’” said Wildey who helped the victim until police arrived.

Police said the shooter’s gun is registered and he had a permit to carry a concealed weapon.

Police said the suspected shooter called 911 shortly after the shooting and waited until police arrived.

This is not going to do any good for the CPL holders here in Michigan. We live in Farmington Hills and this incident happened less than a mile from where my wife works.

Will be interested in seeing what comes of this but I doubt that having someone get out of their car and walk up to the driver's window and 'gonna spit on my face' can be defined as in fear for your life. Spit as a deadly weapon? Intuitive medical diagnosis of AIDS? Sure hope he can afford a really good lawyer because he's going to need one.

Cops expect charges in Farmington Hills road rage incident

Investigators expect to charge a 27-year-old Farmington Hills man with shooting another driver during a road rage argument Monday afternoon in Farmington Hills.

Farmington Hills Police Commander Dave Stasch said today that the man — who has not been identified — will be arraigned in 47th District Court in Farmington at about 3 p.m. on charges of assault with intent to do great bodily harm and felony firearm.

“The message we’re trying to get across is don’t let a traffic altercation evolve into something like this,” Farmington Hills Police Commander Matt Koehn said today.

The Farmington Hills man was apparently brake-checking another car, stomping on his brakes, leading the 20-year-old Commerce Township man behind him at 4:30 p.m. on Orchard Lake Road to have to brake, too.

But when the pair stopped for the light at 13 Mile Road, the 20-year-old got out of his car. He walked up to the Farmington Hills man’s vehicle and they started arguing in the middle of traffic.

The 27-year-old pulled out a gun, which he is licensed to carry with a concealed weapon permit, and fired, hitting the 20-year-old once in the arm, Koehn said.

“Initially he told the officer he was defending himself,” Koehn said. That claim is indefensible, he added. “Obviously, the victim did not have a weapon. He could have just driven away.”

The shooter was arrested at the scene and could be arraigned as soon as today, Koehn said. The victim is expected to fully recover, he added.

Boxed in, and he could have "driven away?" I'm not saying that this is RIGHT by any means, but I'm not saying this 20 year old gets off scott free either. I've never liked the driving habits of the folks in the Detroit Metro area, and this helps solidify it.

If someone starts brake checking me, I'll back off or stop for ice cream. No reason to get my blood pressure up. ;)

The driver got out of his car and started yelling at the chl holder, i understand that he should not have shot the guy but on the same hand maybe he thought the guy was gonna shot him? I dunno what was said in the argument but he easily could have said if you do it again ill kill you.


But he should have just driven off

Lesson learned: have alternative means of dispute resolution.

I always have a can of 10% OC in the center console and I just recently bought one of those tire thumpers truck drivers use. That rides on the floor between my seat and the B pillar, right where my left hand drops down.

Either one will deliver a good attitude adjustment without going nuclear.

no way the shooter can justify this shooting, the other guy was unarmed and as dumb as he was for even getting out of his car and approaching another car he was unarmed and from what i can tell never 'entered' the shooters space(car)???

Seems the liberal media missed a few important facts in this case. It has gone to trial and what came to light was that two (2) men got out of the car and threatened the defendent. The guy that got shot was spitting on the defendent and then moved his hand in such a way that it appeared he was drawing a weapon from his waistband.

The reporters never mentioned those facts....

The judge has declare a mis-trial as the jury was deadlocked at 9-3 to ACQUIT.

Force disparity (being outnumbered) is considered legal grounds to defend yourself if you are in fear for your life or great bodily harm.

The bad news is that the guy will have to go through another trial. His bond was reduced to $50,000 and he is trying to raise the $5K to get out of jail.

His retrial is set for October 14th.

Sad part is- if the guy had called the police and said there is a car in front of me purposbly hitting his brakes. They would probaly have not done anything. Would give the usual advice to just back off- in which case I'm sure the other car would have done too. Still leaving the guy to deal with the situation.

That club in your car can be defined as a concealed weapon which isn't covered by your CPL. As far as spreys, wasp and hornet sprey reach up to 20ft. and in the eyes it blinds your assailant untill a doctor cleans it out.:thumb:
